The Selected Issues of Customer Protection

This thesis is dedicated to the issues of customer protection, mainly the problems in the field of distance consumer contracts. It is performed by realisation of a questionnaire survey between consumers in different age groups. In theoretical part the keywords are described, which are related to this issue. What is the consumer protection and its history. How the terms consumer, businessman and consumer contracts are defined. What is ordered by Czech legislative for the field of consumer protection. Which institutions operate in this field. What is a distance consumer contract. The practical part performs the analysis of questionnaire survey. Low knowledge of legislative regulation of consumer protection among ordinary consumers is defined as the main issue. In conclusion there are proposed some steps to improve the situation.
Consumer protection in a selected product range

The aim of this thesis is to use my own research, both theoretical and practial, to find out how much is the current Czech consumer wiling to fight for his own rights in case he disagrees with the suppliers. Since the consumer protection represents a broad field we will focus on a specific segmet and that is shoe business. Furthermore, we will try to use a survey to map the willingness of the shoe sellers to abide by the consumer protection law.
Worksheets for teaching financial mathematics at secondary school-- financial credit and insurance products, consumer rights

The aim of the thesis is devoted to creation of working sheets which are designed to teach selected topics of financial mathematics at high school. The thesis will focus on loan products (consumer loans, hire purchase, mortgage) insurance products (life and non-life insurance) and the rights of consumers. The thesis issues on the framework educational programs for high schools.
Liability for defects and guarantee according to the Civil Code

The aim of this thesis is to analyse legal regulation of liability for defects and guarantee in Czech civil code and to elaborate problematic paragraphs of this area of law. Thesis defines general regulation, specific regulation for separate contracts and also specialities of consumer law according to civil codes no. 40/1964 and no. 89/2012. There are defined principles of liability for defects and guarantee liability, rights from liability for defects and complaint procedure. Thesis also contains comparision of Czech legal regulation with the English one. Law of European Union is added too, there is summarized the accuracy and suitability of implementation of European directive no. 1999/44/ES into the Czech Civil Code.
Consumer Protection and out-of-court Settlement

Based on the analysis of legal regulations, data and other information regarding consumer protection, it is proposed to establish a specific system of out-of-court settlement of consumer disputes. The settlement is proposed in three variants, showing the best variant, and meets the basic principles and objectives for this type of settlement of consumer disputes -- transparency, better efficiency and low cost. The system was proposed based on information obtained from international studies, documents, national sources -- the market surveillance authority, non-governmental consumer associations, etc. as well as on experience with preparing and implementing the recent pilot project of out-of-court settlement of consumer disputes.
Consumer Protection (Institutional Approach)

The objective of the work is to evaluate the achieved level of development of consumer protection, in particular in the European and Czech context, as well as to analyse the current state of consumer protection in the Czech Republic, with a special emphasis on the analysis of the actual protection and enforcement of consumers' rights in the Czech Republic. The following three working hypotheses are set out in the work: Hypothesis No. 1: The pre-condition for enforcing consumer protection is improving on a world wide scale. Hypothesis No. 2: The consumer policies of the Czech Republic respect the European principles of consumer protection, and form the framework for the effective enforcement of consumers' rights. Hypothesis No. 3: The actual enforcement of consumers' rights depends not only on the working of the relevant state authorities, but also on the level of knowledge among the consumers, and their willingness and ability to enforce their rights. The work is divided into four basic parts. The first part is devoted to the theoretical solutions, and the economic context of consumer protection. It attempts to answer the question of whether consumer protection has some theoretical justification. The text shows that the substantiation of consumer protection consists, in particular, in the levelling of informational asymmetry, which is one of the most frequent causes of market failure. Therefore, it is consumer protection in the form of state intervention in the economy which reduces dis-equilibrium on the market. The second part analyses the development of consumer protection, and evaluates the state of consumer protection in the world and European context. The world context is understood in the global scale, and its analysis should confirm, or overturn, the first working hypothesis. Upon analysis of the relevant data it may be stated that the findings of this part of the work confirm the first hypothesis. Ever more countries belong to that group of countries which can provide their citizens with a high standard of consumer protection, such as that normally envisioned in U.N. policy. The European context is viewed through the prism of our membership in the EU, and its analysis is vital to understanding the state of consumer protection in the Czech Republic. The third part of the work is devoted to the analysis of the development and evaluation of consumer protection in the Czech Republic; together with the previous part, this part provides sufficient basis for the evaluation of the second hypothesis. It must be said that, with a few small exceptions, the legislative provisions for the protection of consumers in the Czech Republic are completely harmonised with consumer protection legislation in the whole EU, in other words, the European framework of consumer protection is completely respected. On the other hand, more detailed analyses of the development of consumer protection in the CR, and analysis of government consumer policy, has revealed certain reservations in this area. The second hypothesis, then, could be confirmed; nonetheless, in the creation of an effective framework for the enforcement of consumers' rights, there is still some room for improvement. The fourth part concentrates mainly on the evaluation of research among consumers, which should confirm, or overturn, the third hypothesis. The research was questionnaire based, and, subsequently, there were processed questionnaires from 313 respondents. The results were interpreted in connection with demographic factors, such as: age, education, sex and profession. Analysis of these results confirms the third hypothesis. That concerns, mainly, the willingness, knowledge and ability of the consumers, which have significant influence on the actual enforcement of their consumer rights. These attributes are individual qualities, which do not play any significant role in following demographic characteristics.

The work is divided into 2 parts. First part deals with general level of consumer protection. It specifies consumers discretions and duties, analyses concrete laws that govern consumer protection and institutional reinsurance of consumer protecion in the Czech Republic. The second part analyses situation in foodstuff area, it warns against traps of the market and underline quality brands, which can make consumer's choice easier.

The main aim of my work is to determine consumers' knowledge of their rights. I am interested in this issue both in general terms and with a focus on food. The necessary information was obtained from marketing research especially by asking consumers. The conclusion includes the results of this research and also proposals to improve consumer foreknowledge. These proposals were consulted on the Consumers Defence Association in Ceske Budejovice.
Specified problems of consumer protection

Problems of consumer protection are always on the surface and they concern all of us. Consumer protection should not only be important for consumers, but for all of society as well. The aim of consumer protection is the existence of convenient consumer rights, supervisory institutions and consumer organizations. The task of these consumer organizations is giving information, advising and educating consumers. The well-educated and informed consumer will be equal partners with sellers, who are claiming (reporting) their law or legal rights. My work, for the most part consists of claims and responsibility for problems in the Tábor region. The aim of this work is discovering if the residents of the Tábor region know their consumer rights. From my marketing research, in the form of a questionaire, most consumers know where to find information in the field of consumer protection (the most important source is the internet). They also know their rights and know how to protect these rights. An active approach of consumers and a fair approach of sellers will help us to build a society in which morality, honesty, rights and justice are the first priority.
